Policies and Client Agreement
*By requesting work from the owner of this website, you understand and agree to the following:
*Projects that insult Jesus Christ or Christianity as a whole, promote racism, promote homophobia, promote transphobia, or promote sexism against women or men will be rejected.
*The client is the person who is paying for the piece, or making the purchase on behalf of their business or organization. They are entitled to request edits and order one additional rewrite/draft, for a total of two drafts, per $100 fee. If you are not paying for the article, you are not entitled to request edits or approve the article before submission or publication.
*No projects that glorify or promote abuse of any kind will be accepted.
*Rejecting second drafts, cancelling projects after the first draft, or failing to either approve or request edits within five days of receiving the first draft will result in a $30 kill fee and rejection of all future writing assignments.
*If you are a local artist, the article can be about any topic. If you are not a Utica area based artist, the article must be about the arts or an artist. Any temporary exceptions to this policy will be announced separately.
*Work printed, posted, or published with my byline must not be altered without my permission, except for basic editing tasks like fixing gaps in text or formatting the piece for a new space.
*Work printed, posted, or published without my byline may be altered as much as the client wishes without consulting me.
*There is no difference in cost or other policies between a piece with my byline and a piece without my name on it. Some clients prefer a byline with someone's name and "Arts Writer," on it for a more professional look, while others prefer a piece without a byline so they can alter it and/or attribute it to their staff.
*I am not responsible for the response to any work a client approves. If I ghost write (meaning write without a byline or with your byline) a controversial opinion piece or other document, and it results in negative reviews, a loss of business, angry responses, or other unwanted results, I am not liable in any way.
*The client does not owe me anything beyond my fee. I am not entitled to any further compensation, promotion, or other benefits, even if my piece generates additional income or brings in more business.
*Payment is due upon acceptance of the final draft for publication, unless previous arrangements have been made. Payments should be made via CashApp to $ArtistCafeUtica. Clients who are unable to use CashApp may contact me to make alternate arrangements. I do not take checks from individuals, only established businesses or nonprofit organizations.
*Clients understand that I am not their employee and they are not my employer. I am an independent artist, meaning I am only hired to do the work of the project. I do not provide cleaning services, secretarial services, or other non-writing services to clients. Work that requires me to fill out a w-4 form, making me an employee, will not be accepted.
*As an independent artist, I understand that I am not entitled to any tips, bonuses, or other benefits offered to employees, including keys to the building, internet passwords, access to employee lounges, or other gathering spaces online or offline. The client may offer these to me if they would make the work go smoother, but I understand that they are only to be used for the client's project.
*Clients understand that they are paying for finished work by a professional. The client may specify activities only if they are vital to the completion of the project, such as requesting that I interview someone and write a profile of that person, or eat food from a restaurant in order to review it. They may not dictate interview questions, help me write the piece, or in any other way direct me in my business as an independent artist.
*Requesting that I speak to an outside source is fine, but the source should be made aware that they will be talking to an independent writer, and any questions, concerns, or other issues with the interview process must be handled directly through me.
*Clients are not to imply or lead anyone to believe that I am their employee or staff member, and I agree not to represent myself as the staff member of any business or organization that hires me as an independent artist.
*Projects are only considered accepted when I receive a topic, specific due date, and any other pertinent details, and respond via email indicating that I accept the project and will have it to the client by that date.
*I reserve the right to terminate any project that violates any of these policies. I understand that to do so means cancellation of my project fee.
